This Disclaimer ("Disclaimer") is issued and published by Life and Beyond Technologies Private Limited (“Company”) and governs the voluntary disclosure of information by any user or participant (“User”) accessing or availing any services, materials, features, content, or functionality offered through the Company’s digital platform, including but not limited to the CU application, CU.LIFE website, and associated smartphone applications available on Google Playstore, Apple App Store, or any other medium (“Platform”). By accessing the Platform and voluntarily sharing any information, the User confirms that he/she/they or them has read, understood, and agreed to be bound by the terms of this Disclaimer.

1. That the User voluntarily, knowingly, and willingly discloses certain information including but not limited to personal, financial, business, or legally sensitive information, medical data, health records, proprietary data, identification documents (hereinafter referred to as “Confidential Information”) for the limited purpose of availing services through the Platform. The disclosure of such Confidential Information is made without any pressure, coercion, misrepresentation, undue influence, or fraud and is solely at the discretion of the User. All information shared by the User with their respective intended recipients, such as Will Executors, Beneficiaries, Guardians, Trustees, Healthcare Representatives, Family Members, Doctors, Caretakers, or others, whether in connection with Financial Will, Advance Medical Directive (AMD), Consultation Services, Sharoo (Digital Vault), CU Messaging Services (including but not limited to Celebrating Us, Get Well Soon, Farewell Messages), Memories (including but not limited to Life Review, Charity, Virtual Memorial, or any other service), is shared with complete awareness, sound mind, and voluntarily by the User.

2. That the Company solely acts as a neutral technological medium and communication channel between the sender and recipient of information, and the services provided are limited to offering an encrypted, end-to-end secure platform for storage, exchange, transmission, and sharing of information. The Company does not vet, censor, validate, verify, moderate, or monitor the content, accuracy, authenticity, legality, or completeness of any information shared between users. The responsibility for any and all information, including any misinformation, misrepresentation, inaccuracy, or omission, lies solely and absolutely with the sender User, and the Company disclaims any legal, financial, emotional, reputational, or mental liability whatsoever arising directly or indirectly from such communications.

3. That the Company shall exercise reasonable and professional diligence in maintaining the confidentiality of the information shared by you. However, the Company expressly disclaims any absolute obligation, fiduciary responsibility, or guarantee with respect to the confidentiality, non-disclosure, or security of the Confidential Information and shall not be liable for any unintentional or unavoidable disclosure thereof due to technological limitations, third-party breach, or regulatory mandate.

4. That the Company is not liable in any manner for the content of any communication, document, information, or consultation exchanged through or facilitated by the Platform, nor for any consequences, actions, developments, or disputes arising between the sender and recipient, whether online or offline. In particular, for Consultation Services, the User acknowledges that the Platform only facilitates an initial point of contact and provides a means to reach professionals; the Company does not and shall not be construed to engage in providing professional advice, decision-making, or any advisory role. The entire risk, responsibility, and consequences of reliance on any information shared or consultation availed lie exclusively with the User.

5. That the User acknowledges and accepts that the Company’s role is purely limited to providing technological access and infrastructure for facilitating communication and secure information management, and the Company expressly disclaims any and all liability for any transactions, exchanges, interactions, disputes, agreements, decisions, losses, grievances, misunderstandings, or damages arising between Users, professionals, or third parties engaging through or post the use of the Platform.

6. That CU or its licensors retain all ownership and intellectual property rights to the programs, operating system, integrated software and anything developed or delivered to you while availing the services under this CU. The Company and/or its licensors retain all rights, title, interest, and intellectual property in and to all content, source code, software, proprietary systems, documentation, brand names, trademarks, databases, and materials provided or made accessible through the Platform. The User shall have no right, title, license, or interest in or to any of the intellectual property of the Company other than a limited, non-exclusive, non-transferable, and revocable right to access and use the Platform solely for availing services as permitted under the applicable terms.

7. That the User hereby undertakes to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, consultants, licensors, and representatives from and against any and all claims, actions, damages, liabilities, costs, fines, penalties, losses, and expenses (including reasonable legal fees) arising out of or in connection with (i) any inaccurate, misleading, incorrect, illegal, unlawful, or incomplete information voluntarily provided by the User; (ii) any violation of applicable law, this Disclaimer, or the Platform’s terms of use by the User; (iii) any third-party claim arising out of or related to the disclosure or reliance upon Confidential Information shared by the User.

8. That the User understands and agrees that in cases where Users swap roles as senders and receivers for different communications and services at different times, the responsibility, liability, and legal consequences attach exclusively and solely to the sender role at the relevant time of each transmission. The receiver shall have the free will and absolute discretion to accept, reject, respond to, act upon, or disregard any communication without any obligation or liability imposed upon the Company.

9. That your Confidential Information shall not include information that: (i) is or becomes a part of the public domain through no act or omission of the other party; (ii) was in the other party’s lawful possession prior to the disclosure and had not been obtained by the other party either directly or indirectly from you; (iii) is lawfully disclosed to the other party by a third party without restriction on the disclosure; or (iv) is independently developed by the other party.

10. That the User acknowledges and agrees that the Company shall not be liable for any direct, indirect, incidental, consequential, punitive, reputational, or special damages arising out of or in connection with the use of or inability to use the Platform, the services provided thereunder, or any unauthorized use or disclosure of Confidential Information, whether based on contract, tort, negligence, equity, strict liability, or otherwise, and even if the Company has been advised of the possibility of such damages.

11. That this Voluntary Disclosure Undertaking is irrevocable and is governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with this Voluntary Disclosure Undertaking shall be subject to the exclusive jurisdiction of the courts in Vijayawada, Andhra Pradesh.

12. That by continuing to use or access the Platform, the User confirms that he/she/they or them has read, understood, and voluntarily accepted the terms and legal consequences of this Disclaimer, and that the execution or acceptance of this Disclaimer has not been influenced by any promise, inducement, assurance, or representation not expressly stated herein.
